AB Trusts…Are They Necessary or Obsolete?
When the new Tax Cut Job Act (TCJA) went into effect January 1, 2018, the Federal Estate Tax was abolished for all those but .002 of the population. This was made possible by the annual upward adjusting exemption which is $11.4M for individuals and $22.8M for married. Until 2012, the AB Trust was the common strategy used. Although it was complex and costly, it provided necessary tax relief. With the passage of the TCJA, the question today is whether the costs, complexity and complications still warrant an AB Trust.
